Introduction
What are prohibitions and restrictions?
The European Union acquis includes a significant number of legal provisions that mandate customs authorities and other relevant authorities to carry out controls at EU external borders. Such controls are key to enforcing and ensuring compliance with many different policies enshrined in Union law and contribute to the security and safety of the European Union and its citizens.
In accordance with Articles 134 and 267 of Union Customs Code1 (UCC), prohibitions or restrictions may be imposed on imports, exports or goods in transit when they are justified on grounds of:
public morality, public policy or public security,
the protection of health and life of humans, animals or plants
the protection of the environment
the protection of national treasures possessing artistic, historic or archaeological value
and the protection of industrial and commercial property
including controls on drug precursors, goods infringing certain intellectual property rights and cash.
